Welcome to NaviHire. By accessing our website at https://navihire.com, you agree to these terms of service in full. If you disagree with these terms or any part of them, you must not use our website.

1. Acceptance of Terms

By accessing or using NaviHire's website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated by reference. Our Privacy Policy describes our privacy-first approach, including our use of cookieless analytics and minimal data collection.

2. Service Description

NaviHire's website currently serves as an information platform and early access registration system for our upcoming developer onboarding platform. The website allows you to learn about our services and join our early access waitlist.

3. Early Access Program

By registering for our early access program, you understand and agree that:

  • Your registration data (email, name, company) will be processed by GetResponse for communication purposes
  • You will receive updates about our product development and launch
  • Early access is provided on a first-come, first-served basis
  • We make no guarantee regarding when you will receive access
  • Features and pricing described are subject to change
  • You can unsubscribe from communications at any time

4. User Obligations

As a user of our website, you agree to:

  • Provide accurate and complete information when registering for early access
  • Use the website in compliance with all applicable laws
  • Not attempt to interfere with the proper functioning of the website
  • Not use automated systems to access the website
  • Be at least 18 years of age

5. User-Generated Content

You retain all ownership rights to any content you create, upload, or share through our service (“User Content”). By submitting User Content, you grant NaviHire a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display that User Content in connection with the services we provide to you.

We reserve the right, but not the obligation, to monitor, edit, or remove any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

6. Intellectual Property

All content and materials available on NaviHire, including but not limited to text, graphics, website name, code, images, and logos are the intellectual property of NaviHire and are protected by applicable copyright and trademark law. You may not use, reproduce, distribute, modify, or create derivative works based upon our intellectual property without our explicit permission.

7. Account Termination

We reserve the right to suspend or terminate your access to the service, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

Upon termination:

  • Your right to use the service will immediately cease
  • We may delete or archive your User Content
  • Any fees paid are non-refundable unless otherwise specified or required by law
  • You can request deletion of your personal data in accordance with our Privacy Policy

8. Warranties and Disclaimer

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND. NAVIHIRE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

NAVIHIRE MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS, OR THAT DEFECTS WILL BE CORRECTED.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NAVIHIRE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL NAVIHIRE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless NaviHire, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the service or your violation of these Terms.

11. Data Security and Breach Notification

We implement reasonable security measures to protect your data, as described in our Privacy Policy. In the event of a data breach affecting your personal information, we will notify you in accordance with applicable laws within a reasonable timeframe, providing information about the breach and steps taken to address it.

12. Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or the Service, the parties shall first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved through negotiation, both parties agree to first attempt to resolve the dispute through mediation before resorting to arbitration or litigation.

13. Governing Law

These terms shall be governed and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. The courts of Krakow, Poland shall have exclusive jurisdiction over any dispute arising from these Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

15. Changes to Terms

We reserve the right to modify these terms at any time. If we make changes, we will provide notice of such changes by updating the date at the bottom of these terms and by providing additional notification methods as appropriate. Your continued use of the service after any such changes constitutes your acceptance of the new Terms.
